Berlin. (bpvv) Der Bundesverband Produktverantwortung für Verkaufsverpackungen (BPVV) hat zu aktuellen offenen Fragestellungen der 5. Novelle der VerpackV ein Gutachten in Auftrag gegeben. Die Gutachter Dr. Henning Tegner (KCW GmbH Berlin) und RA Dr. Johannes Brinkschmidt (Hamburg) kommen darin zu dem Ergebnis, dass die wettbewerbsbeschränkenden Rahmenbedingungen der Novelle durch die Möglichkeiten der Eigenrücknahme und der Branchenlösungen zwar an zwei Stellen durchbrochen werden. Allerdings sei zu befürchten, dass Verwerfungen in Form von erkennbaren Möglichkeiten des Missbrauchs funktionsfähige Wettbewerbselemente beeinträchtigen könnten.
